Welcome! These Terms of Service ("Terms") are an agreement between you and INITECH Solutions LLC ("INITECH", "we", "us") and govern your use of our mobile games, this website (initec-games.com) and related services (together, the "Services"). Please read them carefully. By downloading, accessing or using our Services, you agree to these Terms.

1. Eligibility

You must be able to form a binding contract to use the Services. If you are a minor in your jurisdiction, you may use the Services only with the involvement and consent of a parent or legal guardian.

2. Licence to play

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and play our games for your own private, non-commercial entertainment, subject to these Terms and the rules of the app store you downloaded from.

3. Things you agree not to do

  • Copy, modify, reverse-engineer, decompile or create derivative works of the Services, except where the law expressly permits.
  • Cheat, use bots or exploits, or interfere with the fair play, servers or security of the Services.
  • Sell, rent, sublicense or commercially exploit any part of the Services without our written permission.
  • Use the Services for anything unlawful, harmful, or that infringes others' rights.

4. In-app purchases & virtual items

Some games offer optional in-app purchases and virtual items (coins, boosters, cosmetics, etc.). Virtual items have no real-world monetary value, are licensed not sold, and cannot be exchanged for cash. All purchases are processed by the relevant app store (e.g. Google Play), and their terms and refund policies apply. We may change, limit or remove virtual items over time.

5. Advertising

Our free games are supported by advertising. By playing, you understand ads may be shown. We work to keep advertising appropriate and family-friendly, as described in our Privacy Policy.

6. Intellectual property

The Services, including all games, artwork, characters, logos, text, sounds and software, are owned by INITECH or our licensors and are protected by intellectual-property laws. The INITECH name and logo are our trademarks. Nothing in these Terms transfers ownership to you.

7. User content & feedback

If you send us suggestions, ideas or feedback, you grant us a free, worldwide, perpetual right to use them to improve the Services, with no obligation to you. Please don't send us anything you consider confidential.

8. Updates & availability

We may update, change or discontinue games, features or the Services at any time, with or without notice. We don't guarantee that the Services will always be available, uninterrupted or error-free, though we do our best to keep things running smoothly.

9. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. You use the Services at your own discretion and risk.

10. Limitation of liability

To the fullest extent permitted by law, INITECH and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the Services. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim, or USD 50.

11. Termination

You may stop using the Services at any time by deleting our games. We may suspend or terminate your access if you breach these Terms or misuse the Services. Sections that by their nature should survive (such as intellectual property, disclaimers and limitation of liability) will continue to apply.

12. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Any disputes will be handled by the courts located in Florida, unless a mandatory local law of your place of residence provides otherwise.

13. Changes to these Terms

We may revise these Terms from time to time. We'll post the updated version here and change the "Last updated" date. Your continued use of the Services after changes take effect means you accept the revised Terms.
